Essentially, a broker may never take a load off a loadboard without the originating shipper’s/broker’s knowledge and permission.

Only motor carriers separately registered Property Brokers License may “arrange” transportation on the other motor carrier, invoice the shipper for that arrangement, pay the carrier, less an agreed commission, without reference to the originating motor carrier. Two completely separate businesses must be established, and the business operations activities, including payroll, may not be shared. The intent of Congress is “transparency,” but the FMCSA enforces these regulations, and the market is in financial chaos because of their incompetence.
