Prior to 2012, transportation allowed motor carriers to broker freight. Now the prohibition of truck brokering contains pretty hefty fines for a carrier who brokers loads without a license and bond. Transparency and financial responsibility are the watchwords of the latest law adaptations. However, the new law has had just the opposite effects as to the law’s intentions. Co-brokering, double brokering, re-brokering and fake interlining, is rampant in today’s industry. Technology to the elimination of the evils of re-brokering outlined has not been readily adopted by the industry.

Legislative failure causes two things, loadboards, (which allow brokers’ and shippers’ loads to appear in a public forum) and the misguided perception that motor carriers work for brokers, and not the other way around. It is estimated that the amount of motor carrier lost revenue to unearned extra broker commissions exceeds $17 Billion annually.
