Nature of Freight Rates
You have just read how freight rates are developed in a brokerage compliant with
MAP 21. The development of freight rates occur from an open marketplace, not from some
“tariff”. Tariffs were outlawed in 1981, and put to death, when the Federal Government
removed the Sherman Anti Trust price fixing protection in 2005, Rate bureaus had enjoyed
government sanction price fixing since 1936. Tariffs today are advisory. The government is
out of the price fixing business and Tariffs no longer enforceable. Publishing freight rates
however is a more frequently occurring event on the Internet, and is quite legal, Discount

marketplace, freight rates are increasingly negotiated on a spot basis. Shippers who stick
